Terms & Conditions of Use

The following terms and conditions govern all use of (i) the Elementary Analytics website (the Site), and (ii) the services and products available at or through the Site (the Service). The Service is owned and operated by Elemantary Analytics. The Service is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on this Site by Elementary Analytics (collectively, the Terms & Conditions of Use).

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING THE SITE OR OTHERWISE USING THE SERVICE. BY ACCESSING THE SITE OR USING ANY PART OF THE SERVICE, YOU (EITHER AN INDIVIDUAL OR A LEGAL ENTITY THAT YOU REPRESENT AS AN AUTHORIZED EMPLOYEE OR AGENT) (YOU) AGREE THAT YOU ARE BOUND BY THE TERMS AND CONDITIONS OF THESE TERMS OF USE. IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS OF THESE TERMS OF USE, THEN YOU MAY NOT ACCESS THE SITE, SERVICE, OR ANY PART THEREOF. ELEMENTARY ANALYTICS’ ACCEPTANCE IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL OF THE TERMS AND CONDITIONS OF THESE TERMS OF USE, TO THE EXCLUSION OF ALL OTHER TERMS; IF THESE TERMS OF USE ARE CONSIDERED AN OFFER BY ELEMENTARY ANALYTICS, YOUR ACCEPTANCE IS EXPRESSLY LIMITED TO THESE TERMS.

The Service is available only to individuals who are at least 16 years of age. If you do not so qualify, do not attempt to use the Service. Elementary Analytics may refuse to offer the Service to any person or entity at any time and may change its eligibility criteria, at any time, in its sole discretion.

Modification

Elementary Analytics reserves the right, at its sole discretion, to modify or terminate the Service or to modify this Agreement, at any time and without prior notice. If we modify the Service or this Agreement, we will post the modification on the Elementary Analytics website (the “Site”) or provide you with notice of the modification. By continuing to access or use the Service after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to use the modified Service and/or to be bound by the modified Agreement. If the modified Service or Agreement is not acceptable to you, your only recourse is to cease using the Service.

Fees

If you have purchased a paid Service, you are expressly agreeing that Elementary Analytics is permitted to bill you the applicable fees. Any applicable tax and any other charges you may incur with Elementary Analytics in connection with your use of the Service and that the fees will be billed to the payment settings you selected when creating a subscription via PayPal in accordance with the billing terms in effect at the time a fee or charge is due and payable.

If payment is not received in advance of the applicable subscription period, Elementary Analytics reserves the right to either suspend or terminate your access to the Site and/or any Service and terminate these Terms of Use.

Subscription fees are payable in British Pounds and based on Services purchased and not on actual usage. All fees are non-refundable. The Service is billed in advance on a monthly or yearly basis and is non-refundable.

There will be no refunds or credits for partial months of service or refunds for months unused with an open account. If you have purchased a paid subscription to the Service, your subscription will automatically renew for additional, successive subscription periods equal in duration to the initial subscription period that you initially purchased unless you terminate your subscription prior to the next renewal period.

You acknowledge and agree that Elemantary Analytics will automatically charge via Paypal for the then-current subscription period upon the commencement of any renewal period.

You may terminate your subscription to the Service at any time and you will not be obligated to pay any additional fees for upcoming subscription renewal periods but any subscription fees you have paid in advance will not be refunded.

By using the the Service, you consent to receiving electronic communications from Elementary Analytics. These electronic communications may include notices about applicable fees and charges, transactional information and other information concerning or related to our Service. These electronic communications are part of your relationship with Elementary Analytics and you receive them as part of your subscription to the Service. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Registering For The Service

In order to use the Service you must register to create an account (“Account”). During the registration process, you will be required to provide certain information to us and you will establish a username and a password.

You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Elementary Analytics reserves the right to suspend or terminate your Account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete.

You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your Account, whether or not you have authorized such activities or actions. You will immediately notify Elementary Analytics of any unauthorized use of your Account. By signing up for Elementary Analytics you agree that Elementary Analytics may send you occasional emails relevant to your use of the Elementary Analytics service.

Privacy Policy

Your use of the Site and the Service is governed by Elementary Analytics Privacy Policy, which is incorporated into this Agreement by reference.

Termination and Account Cancellation

If you breach any of this Agreement, Elementary Analytics will have the right to suspend or disable your Account or terminate this Agreement, at its sole discretion and without prior notice to you.

Elementary Analytics reserves the right to revoke your access to and use of the Service at any time, with or without cause. You may cancel your Account at any time.

Third Party Sites

The Service may permit you to link to other websites or resources on the Internet, and other websites or resources may contain links to the Site. These other websites are not under Elementary Analytics’ control, and you acknowledge that Elementary Analytics is not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources.

The inclusion of any such link does not imply endorsement by Elementary Analytics or any association with its operators. You further acknowledge and agree that Elementary Analytics shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such Content, goods or services available on or through any such website or resource.

License

Unless otherwise stated, Elementary Analytics and/or it’s licensors own the intellectual property rights for all material on Elementary Analytics. All intellectual property rights are reserved. You may view and/or print pages from https://app-elementaryanalytics.azurewebsites.net/ for your own personal use subject to restrictions set in these terms and conditions.

You must not:

1. Republish material from https://app.elementaryanalytics.com/ or https://elementaryanalytics.com
2. Sell, rent or sub-license material from https://app.elementaryanalytics.com/ or https://elementaryanalytics.com
3. Reproduce, duplicate or copy material from https://app.elementaryanalytics.com/ or https://elementaryanalytics.com

Redistribute content from Elementary Analytics (unless content is specifically made for redistribution).

Hyperlinking to our Content

1. The following organizations may link to our Web site without prior written approval:

   4. Online directory distributors when they list us in the directory may link to our Web site in the same manner as they hyperlink to the Web sites of other listed businesses; and

1. Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.

Content Liability

We shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website.
